How long do I have to reply to an objection?

You generally have one month from receipt of the examination report to file your reply. Missing the deadline can lead to the application being treated as abandoned, so we prepare and file the response well within time.

What is the difference between Section 9 and Section 11 objections?

Section 9 covers absolute grounds — such as the mark being descriptive, generic or lacking distinctiveness — while Section 11 covers relative grounds, mainly similarity to an existing mark that could cause confusion. The defence differs for each, and we tailor the reply accordingly.
